1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Simakade website, services, content, applications, downloadable resources, and related platforms (collectively referred to as the "Platform").

Simakade is an African safari field guide, travel research platform, content publisher, directory, and marketplace designed to help travellers research, compare, understand, and plan safari experiences across Africa.

Simakade provides information, educational resources, directory services, discovery tools, and marketplace services.

Simakade is not a travel operator and does not arrange, manage, operate, or fulfil travel services on behalf of travellers.

3. Eligibility

You must be at least 16 years old to create an account or submit information through the Platform.

By using the Platform, you represent that:

• You have the legal capacity to enter into binding agreements.

7. Accommodation Listings and Tour Operator Listings

Information may be supplied by stakeholders, contributors, third-party sources, or compiled by Simakade through independent research.

Simakade does not guarantee:

• Pricing
• Service quality
• Accuracy of stakeholder-supplied information
• Accuracy of third-party information
• Continued operation of listed businesses

Users should independently verify information directly with the relevant provider before making decisions or entering into agreements.

8. No Travel Contract

A booking, reservation, purchase, enquiry, travel agreement, accommodation agreement, tour agreement, or other arrangement made with a third-party provider creates a contractual relationship solely between the user and the relevant provider.

Simakade is not a party to any agreement between travellers and accommodation providers, tour operators, guides, transport providers, booking platforms, or other third parties.

Simakade is not responsible for:

• Booking disputes
• Service delivery
• Cancellations
• Refunds
• Pricing changes
• Supplier insolvency
• Service interruptions
• Travel disruptions

All rights and obligations relating to a booking remain solely between the user and the relevant provider.

9. Stakeholder Services and Payments

Simakade may offer paid services to accommodation providers, tour operators, guides, experts, advertisers, and other stakeholders.

These services may include:

• Listing subscriptions
• Featured listings
• Advertising opportunities
• Promotional services
• Marketplace products
• Future business services

Fees, billing cycles, and service details may be communicated separately.

Failure to make payment may result in suspension or termination of services.

Unless otherwise required by law, fees paid to Simakade are non-refundable once services have commenced.

10. Reviews and User Content

Future Platform features may permit users to submit:

• Photographs

• Other user-generated content

Users remain solely responsible for content they submit.

You agree not to submit content that:

Simakade reserves the right to review, edit, refuse, remove, or moderate content at its sole discretion.

By submitting content to Simakade, you grant Simakade a worldwide, perpetual, non-exclusive, transferable, royalty-free licence to:

such content for purposes related to operating, improving, promoting, and developing the Platform.

You retain ownership of your original content.

Users may not reproduce, copy, distribute, sell, republish, or exploit Platform content without prior written permission.

22. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any dispute arising from or relating to these Terms or the Platform shall be subject to the jurisdiction of the courts of South Africa.
